This Online Privacy Policy ("Policy") is a part of and is incorporated into the Terms of Service Agreement ("Agreement") for the AmericanExcellenceFoundation.org website.  AmericanExcellenceFoundation.org is a website of the American Excellence Foundation (“Foundation”), a non-profit organization established and operated in a manner consistent with section 501(c)3 of the U.S. Internal Revenue Code.

We respect the privacy rights of our online visitors and recognize the importance of protecting the information collected from you. This Policy applies to information collected about you upon access to the Site. This Policy guides how we collect, store and use the information you provide online.  This Policy applies only to websites maintained by the Foundation and not to websites maintained by other unaffiliated organizations to which we link.

What Information We Collect

This policy applies to information that personally identifies you. It does not apply to information that is considered publicly available. We may collect both personal and public information. Our primary goals in collecting Personal Information are to provide you with the information, resources and services made available through the Site, and to communicate with you.

Both Personal Information and public information about you may be collected directly from registrations you complete and submit to us on the Site. This information may also be collected indirectly from your access to the Site.

Some information about you is collected automatically when you access the Site. Foundation servers will automatically record information that your browser sends whenever you visit the Site. Collected data may include information such as your IP address, browser type or the domain from which you are visiting, and the search terms you use. We use this information to monitor your use of the Site and its services, and for the Site's technical administration. We do not associate your IP address with any other Personal Information in order to identify you, except in case of violation of the Agreement.

The Foundation web based system will issue cookies when you access the Site, unless you have disabled them on your browser. The American Excellence Foundation is not responsible for the privacy practices and policies of the other party whose information or services are available through this site. Children’s Privacy
The services are intended for general audiences over the age of 13 years old. Children under the age of 13 cannot submit any personal information to us. If you are under the age of 13, you may use this service only with a parent or guardian. Parents or guardians should become knowledgeable about software and other tools so they can assure that children’s use of the Internet reflects parental preferences and requirements. If we become aware that we have collected personal information (as defined by the Children’s Online Privacy Protection Act) from children under the age of 13, we will take reasonable steps to delete it as soon as possible.

If you are a California resident, you may ask us to refrain from sharing your information (whether collected online or offline) with our affiliates for their marketing purposes, if the affiliates are separate legal entities. What Information Do We Share With Others
We do not, except as noted below, share or disclose your personal information with other parties for any purpose which is not related to Daniels Fund business activities.
Personal Information may be shared with other parties who provide services to us, at our direction and only in connection with our business activities. Our service providers are obligated to keep personal information we share with them confidential and use it only to provide services specified by us.


We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, comply with legal process (including subpoenas), protect the property and rights of the Foundation, or a third party, enhance the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity.

Whistleblower Policy

General: The American Excellence Foundation, hereinafter referred to as the Foundation, requires directors, officers, consultants and employees to observe high standards of business and personal ethics in the conduct of their duties and responsibilities. We strive for honesty and integrity in fulfilling our mission and comply with all applicable laws and regulations.

Reporting Responsibility: It is the responsibility of all applicable employees to report ethics violations or suspected violations in accordance with this Whistleblower Policy.

No Retaliation: No director, officer, consultant or employee who in good faith reports an ethics violation shall suffer harassment, retaliation or adverse employment consequence. An officer, director, consultant or employee who retaliates against someone who has reported a violation in good faith is subject to discipline including termination of employment. This Whistleblower Policy is intended to encourage and enable employees and others to raise serious concerns within the Foundation prior to seeking resolution externally.

Reporting Violations: The Foundation has an open door policy and suggests that directors, officers, consultants and employees share their questions, concerns, or complaints with personnel who can address them properly. In most cases, the president is in the best position to address an area of concern. However, if an employee is not comfortable speaking with the president or is not satisfied with the president’s response, are encouraged to speak with the legal counsel or any other managerial consultant whom they are comfortable in approaching. The executive director and other managerial consultants are required to report suspected ethics violations to the legal counsel, who has specific and exclusive responsibility to investigate all reported violations. For suspected fraud, or when you are not satisfied or uncomfortable with following the open door policy, individuals should contact the legal counsel directly.

Compliance Officer: The Foundation’s legal counsel is the organization’s compliance officer and has the authority to investigate and resolve all reported complaints and allegations concerning violations and, at his/her discretion, shall advise the President and/or the Board of Directors. The legal counsel has direct access to the board of directors and is required to report at least annually on compliance activity.

Acting in Good Faith: Anyone filing a complaint concerning a violation or suspected violation must be acting in good faith and have reasonable grounds for believing the information disclosed indicates a violation. Any allegations that prove not to be substantiated and which prove to have been made maliciously or knowingly to be false will be viewed as a serious disciplinary offense.

Confidentiality: Violations or suspected violations may be submitted on a confidential basis by the complainant or may be submitted anonymously. Reports of violations or suspected violations will be kept confidential to the extent possible, consistent with the need to conduct an adequate investigation.

Handling of Reported Violations: The Compliance Officer will notify the sender and acknowledge receipt of the reported violation or suspected violation. All reports will be promptly investigated and appropriate corrective action will be taken if warranted by the investigation.
